Terms and Conditions

Payments: A 50% non-refundable deposit is required at the time of booking to secure the Event Date. The remaining

balance must be paid at least 14 days before the event date.


Non-Performance: In the event that Spark Events, LLC. fails to provide a booked service or product, a prorata refund

will be issued to Client for all items not provided.


Changes to Event: Changes to the event must occur no less than 14 days prior to Event Date (30 days for events that

are scheduled in December). Failure to give at least 14 days notice to changes will incur a fee of $75. Changes are not

guaranteed without Sparks express, written approval. Any changes in Event Date, at any point in time, will be treated as

a Cancellation and subject to the Cancellation terms below.


Cancellations: In the event of a Client cancellation initiated by Client, Spark will issue a credit for 25% of any monies

paid by Client. Credits are good towards a future Spark event (no cash value) and will expire 180 days after the Client’s

original Event Date. Spark will not issue any refunds for cancelled events, but will make every effort to re-book an

alternate date, if possible.


Delivery/Event Setup & Teardown: Spark delivery crew will arrive and begin setup no sooner than (2) hours before

the event Casino Open time and will begin teardown/exit at Casino Close time. Additional charges will apply for delivery

requests outside of this window.


Event Space: It is the Client’s responsibility to ensure adequate space is available for all rented equipment and staff. If

some or all of rented equipment does not fit in the space, no refund will be issued for unused item(s).


Elevator & Stairs: Prior to completion of this Agreement, Client is responsible for alerting Spark to any steps/stairs,

elevators, and hazards/obstructions that may affect delivery. Spark reserves the right to refuse delivery and/or charge

additional fees to Client for deliveries Spark deems too difficult and/or unsafe, in its reasonable discretion.


Outdoor Events & Weather: For events that are held outdoors, table placement will be solely at the discretion of

Spark, based on weather and lighting conditions. The Client is responsible for ensuring comfort of all Spark staff

including but not limited to sufficient lighting, reasonable temperature conditions, and a safe working location during

the Event. Adequacy of these conditions are determined at the discretion of Spark personnel (ie. Casino Manager, Lead

Dealer, and/or Delivery Crew), with closure of tables being a last resort. No refunds will be issued for cancellations due

to weather unless separately agreed to.


Furniture and Obstructions: For events that require furniture or other obstacles to be removed from the casino

gaming area, The Client or venue staff are responsible for moving any and all furniture and obstacles/obstructions

before the Delivery Crew arrive. Spark is not responsible for moving any furniture or obstacles before, during, or after

the delivery process. It is highly recommended that the casino gaming area be completely cleared before the arrival of

Spark Delivery Crew.


Dealer Breaks and Table Closures: Spark event staff are entitled to up-to two 10-minute breaks per three (3) hour

event, to be given at a suitable time by the Pit Boss/Manager. Events without Casino Managers/Relief Dealers may

require the temporary closure of a gaming table during a dealer’s break, this does not count as non-performance.


Overtime: If you wish to extend your casino gaming time at the event, fees will be charged at the following rate: $100

per staff per hour which includes all event and delivery staff scheduled. Casino overtime with a reduced staff may be

requested by the Client. Overtime is not guaranteed and will be accepted at the discretion of Spark event staff and their

availability. Client is required to sign an Overtime Agreement at the time of the request and payment will be required

within 7 days of Event Date.


Chip Loss: If twenty (20) or more chips are lost and/or stolen during the Event, Client will be billed at a rate of

$0.50/chip for every chip in excess of twenty. It is recommended that Client provide prizes for casino winners, to ensure

casino chips are turned in by guests at Casino Close.


Smoking: No smoking and/or vaping is permitted at or near Spark equipment and staff. The Pit Boss/Manager/Lead

Dealer will have discretion to close table(s) or request that guests smoke elsewhere. Failure to comply with this

policy will result in one or all casino tables being closed and no refunds will be given (though table closure will

always be a last resort).


Right to Close/Refuse Service: Spark reserves the right to close individual tables or the entire casino, at any time, if

Spark event staff (Pit Boss/Manager/Lead Dealer) deem the event unsafe or hazardous. Guests that exhibit

disrespectful, out of control, or threatening behavior or guests that cause Spark event staff to be uncomfortable or feel

unsafe may be reason for closure of individual table(s) and/or the entire casino, within reasonable discretion of Spark

staff. No refunds will be given for any casino gaming time lost for these reasons.


Bounced Checks: Any bounced (NSF) checks will result in a $50 fee, billed to Client by Spark.


Company Trademarks/Images/Videos: Spark reserves the right to control how Spark trademarks, copyrights, and

corporate images/videos are used, specifically those used commercially. Any commercial use of pictures and/or videos

featuring materials that include Spark trademarks or images of its equipment and staff should be cleared by written

consent from Spark. Use of such materials must be removed from commercial use at Spark’s request.


Insurance: Spark agrees to procure and maintain during the term of this Agreement, at Spark’s own cost and expense,

liability and property damage insurance, including automobile and contractual liability. Spark agrees to provide

appropriate certificates or other evidence of such coverage as may be requested by Client.
